1 - Fortnum & Mason Plc of 181 Piccadilly, London, W1A 1ER ("Fortnum’s") is offering you a chance to win the Prize set out below (the "Promotion"). Fortnum's is the promoter of the Promotion and the terms and conditions below apply to the Promotion. Please read these terms and conditions carefully. By entering the Promotion you are agreeing to be bound by these terms and conditions.

 

2 - This Promotion is only open to UK (excluding Northern Ireland) residents who at the time of entry are aged 18 years old and over and have access to the internet.

 

3 - You may not enter the Promotion if you are: (a) an employee, agent or supplier of Fortnum’s; (b) a member of the immediate family of those set out in (a); or (c) professionally connected with the Promotion or its administration.

 

4 - To enter this Promotion you must sign up for the Fortnum’s newsletter between 6pm on 14 November 2024 and 9pm on 14 November 2024 (the "Closing Date") inclusive (the "Promotional Period"). You can do this by scanning the QR code on the relevant promotional in-store signs and then signing up to our newsletter on the page you will be directed to which is https://www.fortnumandmason.com/welcome-to-fortnums-christmas-hamper-raffle, and providing your email address. You will then be signed up for our newsletter and entered into this Promotion, you may unsubscribe at any time and your data will be handled in accordance with the Fortnum’s privacy policy.

 

5 - Entries must be received during the Promotional Period. Entries received after the Closing Date will not be accepted and will not be entered into the Promotion.

 

6 - There is a limit of one entry per person. If more than one entry is made to the Promotion only the first entry will be eligible. Entries on behalf of another person are not accepted and joint submissions are not allowed.

 

7 - There will be one winner. Fortnum & Mason can substitute some items if required. Winner may not request any cash or other prize alternative. Fortnum’s will cover the cost of postage for the prize within the UK. The winner has 14 days to notify Fortnum’s of a delivery address in the UK for receipt of the prize, failing which the prize will be offered to another winner.

 

8 - Fortnum’s does not accept any responsibility for any costs which are associated with the Prize which are not expressly included in the Prize and any other costs incurred are the responsibility of the winner.

 

9 - The Prize is subject to availability. Fortnum’s reserves the right to substitute the Prize with a prize of equal or greater value. The Prize cannot be exchanged, transferred or redeemed for cash.

 

10 - Fortnum’s will notify the winner by email on or after 14th November 2024 (the "Prize Notification Date") and Fortnum’s will provide details on how the winner can claim the Prize. The winner has 14 days after the Prize Notification Date to claim the Prize. If a winner fails to claim their Prize within that timescale the winner will forfeit the Prize and Fortnum’s may re-award the Prize in accordance with paragraph 13.

 

11 - The Prize will be delivered to the winner within 30 days of the winner claiming the Prize.

13b - if you object to your surname and/or county being made available, please contact Fortnum’s by [writing to: email address]. In such circumstances, Fortnum’s must still provide the information and winning entry to the Advertising Standards Authority on request.

 

14 -Entrants agree that, to the extent permitted by law, Fortnum’s and their employees, will not be responsible for any liability for any losses or damages of any kind in connection with the prize or participation in this Promotion. Nothing in these terms shall be construed to limit or exclude any liability of Fortnum’s for fraudulent misrepresentation, fraud, death or personal injury caused by Fortnum’s negligence or any other liability to the extent the same may not be excluded or limited as a matter of law.

 

15 - Fortnum’s will not accept:

15a - responsibility for entries not successfully completed due to a technical fault of any kind or postal failure; or  

15b - entries that are: automatically generated by computer; completed by third parties or in bulk; illegible, have been altered, reconstructed, forged or tampered with; or incomplete.

 

16 - Fortnum’s decision is final and no correspondence will be entered into. Fortnum’s may require you to provide proof that you are eligible to enter the Promotion.

 

17 - Fortnum’s reserves the right to hold void, suspend, cancel, or amend the Promotion where it becomes necessary to do so due to unforeseen circumstances outside of Fortnum’s control. If there is any reason to believe that there has been a breach of these terms and conditions, at Fortnum’s sole discretion, Fortnum’s reserves the right to exclude you from the Promotion.

 

18 - These terms and conditions, their subject matter and their formation, are governed by English law. You and Fortnum’s both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
